These Terms & Conditions govern the use of the Shot By Dot website and the booking of photography and videography services provided by Dorothy McCormack trading as Shot By Dot ("Shot By Dot", "we", "our", "us").
By accessing this website, submitting an enquiry, making a booking, or purchasing services, you agree to be bound by these Terms & Conditions.
If you do not agree with these Terms, please do not use our website or services.
1. Services
Shot By Dot provides photography, videography and related creative services.
All services are subject to availability and acceptance by Shot By Dot.
We reserve the right to decline bookings at our discretion.
2. Quotes and Bookings
Quotes are provided based on the information supplied by the client and may be subject to change if project requirements change.
A booking is not confirmed until:

a booking fee or deposit (where applicable) has been paid;

any required agreement has been signed; and
-
written confirmation has been issued by Shot By Dot.
3. Payments
Certain services require payment in advance or a non-refundable booking fee.
Payment terms will be communicated before booking confirmation.
Unless otherwise agreed in writing:
-
deposits and booking fees secure the booking date;
-
final balances must be paid by the agreed deadline;
-
final images, videos or deliverables may be withheld until payment has been received in full.
Failure to pay outstanding balances may result in delayed delivery, cancellation of services, or legal recovery of outstanding amounts.
4. Cancellation, Rescheduling and Refunds
Client Cancellation
Booking fees and deposits are non-refundable unless otherwise agreed in writing.
If a client cancels a booking after work has commenced or within a short period before the scheduled service date, Shot By Dot reserves the right to retain payments already made and recover any reasonable costs incurred.
Rescheduling
Requests to reschedule are subject to availability.
Where possible, payments already made may be transferred to a new date agreed by both parties.
Additional fees may apply where rescheduling creates additional costs.
Cancellation by Shot By Dot
In the unlikely event that Shot By Dot is unable to provide services due to illness, emergency, force majeure or circumstances beyond reasonable control, we will make reasonable efforts to:

offer an alternative date;
-
arrange a suitable replacement photographer or videographer; or
-
provide an appropriate refund.
Any refund shall represent our maximum liability.
Refunds
Photography and videography services are creative services.
Refunds will not be issued simply because a client dislikes artistic choices, poses, expressions, weather conditions, venue restrictions, or subjective aspects of the work where services have been delivered with reasonable care and skill.
5. Delivery of Work
Delivery times are estimates unless otherwise agreed in writing.
Delivery may be affected by:

client response times;
-
image selection delays;
-
technical issues;
-
workload;
-
circumstances outside our reasonable control.
Final deliverables are typically supplied electronically unless otherwise agreed.
6. Creative Control
Clients acknowledge that photography and videography are creative services.
Shot By Dot retains full artistic discretion regarding:
-
composition;
-
lighting;
-
editing style;
-
image selection;
-
colour grading;
-
delivery format.
Examples displayed on our website and social media represent our creative style and form part of the basis upon which services are commissioned.
7. Copyright Ownership
All photographs, videos and creative works remain the intellectual property and copyright of Shot By Dot unless expressly transferred in writing.
Nothing in these Terms transfers copyright ownership to a client.
8. Usage Rights
Personal Clients
For portraits, couples, families, private events and similar bookings, clients receive a non-exclusive licence to:

view downloaded content;
-
print images for personal use;
-
share images on personal social media platforms.
Images may not be sold, licensed, substantially altered, used commercially or submitted to competitions without written permission.
Commercial and Corporate Clients
Businesses, organisations, performers, venues, event organisers and commercial clients receive a non-exclusive licence to use delivered content for:
-
websites;
-
social media;
-
advertising;
-
marketing;
-
promotional activity;
-
editorial and public relations purposes.
The licence granted is limited to the purpose agreed during booking.
Exclusive rights, unrestricted licensing, image resale rights or copyright transfer must be agreed separately in writing.
9. Portfolio and Promotional Use
Shot By Dot may use selected photographs and videos created during commissioned work for:

website portfolios;
-
social media;
-
marketing materials;
-
advertising;
-
promotional campaigns;
-
awards submissions;
-
exhibitions;
-
publications;
-
educational and business development purposes.
Clients who do not wish their content to be used in this way must notify us in writing before the shoot, event or project takes place.
We will make reasonable efforts to honour such requests, although content already published may not be immediately removable from all locations.
Nothing in these Terms obligates Shot By Dot to publish any particular image or project.
10. Client Responsibilities
Clients are responsible for:

providing accurate booking information;
-
obtaining any required venue permissions;
-
ensuring access to locations;
-
obtaining any permissions required from participants, performers, staff, attendees or other persons where legally necessary.
For commercial and event bookings, the client confirms they have authority to enter into the agreement and commission services on behalf of the relevant organisation, business or event.
11. Website Use
Users of this website agree not to:

misuse website functionality;
-
attempt unauthorised access to systems;
-
copy website content without permission;
-
use content in a manner that infringes intellectual property rights.
All website content remains the property of Shot By Dot unless otherwise stated.
12. Limitation of Liability
Shot By Dot will perform services with reasonable care and skill.
To the fullest extent permitted by law, we shall not be liable for:

indirect losses;

consequential losses;

loss of profits;

loss of business opportunities;

venue restrictions;
-
weather conditions;
-
technical failures outside our reasonable control;

delays caused by third parties.
Our total liability arising from any booking or service shall not exceed the amount paid by the client.
Nothing in these Terms excludes liability where exclusion would be unlawful.
13. Force Majeure
Shot By Dot shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:

severe weather;

natural disasters;
-
illness;
-
injury;
-
government restrictions;
-
venue closures;
-
power failures;
-
internet outages;
-
transport disruption.
14. Privacy
Personal information is handled in accordance with our Privacy Policy.
By submitting information through our website, you consent to the processing of your information as described in that policy.
15. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
